Drug Offenses

 

There is a wide range of crimes dealing with the use, distribution, possession, manufacturing, cultivation or trafficking of any controlled substance, or illegally using or distributing prescription medication. The term drug offense encompasses a very wide array of drug-related crimes.

Cultivation

~ Typically refers to the act of growing marijuana. 

 

Manufacturing

~ Typically refers to chemically manufacturing a drug, such as cutting processed cocaine, or cooking crystal methamphetamine.

 

Prescription fraud

~ The act of obtaining prescription drugs which were not prescribed to you, or obtaining more than were actually proscribed by using false pretenses. Prescription fraud may also be accomplished by doctor shopping, and lying to doctors about claimed maladies.

 

Trafficking

~ Drug trafficking simply refers to the amount of the drug in question. Each drug has a different trafficking weight, and if you are found to be in possession of a drug in an amount equal to or greater than the statutorily defined trafficking weight, you may be facing a very stiff minimum mandatory trafficking sentence.

 

Possession

~ Simple possession occurs when someone is found to be in actual or constructive possession of an illegal substance.

 

Possession with intent to distribute

~ Possession with intent to distribute is the same as simple possession, but involves a greater amount of the drug in question. Regardless of your actual intent, the law will presume you intended to distribute certain drugs if you are found to be in possession of the requisite quantity or weight. Possession with intent weights are less than trafficking weights, although they’re both felonies.
